DATA CONTROLLER

The Data Controller is Sunstar Engineering Europe GmbH - Italian Branch, in the person of its legal representative, domiciled at its registered office in Via Virgilio , 6 - 20833 Giussano (MB), Italy (hereinafter referred to as the "Company" or "Data Controller" or "Data Controller").

TYPE OF DATA PROCESSED

To enable the use of the Website and its services, the Data Controller needs to know and process the following personal data relating to Users:

  • Navigation data

Whenever Users access the Website, the computer systems and software procedures used to operate the Website acquire, in the course of their normal operation, access and navigation data, such as: information on the browser used by the User, pages visited, date, time and duration of each visit, as well as other parameters relating to the User's operating system and computer environment.

  • Data communicated voluntarily by the User to get in touch with the Company

Through the Website, it is possible to contact the Company, by means of the e-mail addresses, telephone number and fax number indicated in the "Contacts" section or by filling in the "Contact Us" form in the same section of the Website, to request information on the Company's activities, products and services.

The data collected include identification and contact data of the Users (e.g. name and e-mail address), as well as personal data voluntarily transmitted and included in the message sent to the Controller. We recommend that Users only communicate data that is up-to-date, relevant and not excessive for the specific purpose of processing. Any unnecessary data will be immediately deleted or anonymised.

  • Data communicated voluntarily by the User to get in touch with the Company

The Website also collects the personal data necessary to allow the User to register on the Website and proceed to the purchase of the products therein, via the registration form.

In particular:  

  1. a) Identification data, such as the User's first name and surname;
  2. b) Contact data, such as the e-mail address, shipping address and telephone number of the User;

  • Data acquired for subscribing to and receiving the newsletter

On the home page of the Website and in the pop-up displayed when accessing it for the first time, the User may communicate his or her e-mail address in order to subscribe to the Company's newsletter and receive information and updates on the products, activities and services offered.

If you confirm your wish to subscribe to the newsletter service (via the double opt-in procedure and, therefore, by means of the double confirmation expressed by clicking the confirmation button in the e-mail received), the Company will acquire, in addition to your e-mail address, the following personal data: your IP address and the time of the confirmation. The purpose of this procedure is to test your registration to the marketing e-mails and, if necessary, to detect and prevent possible unlawful use of your personal data.

If your registration is not confirmed, your data will be deleted.

  • Data captured via cookies

Cookies are used on the Website to enable the processing of further personal data of the User acquired during the User's navigation on the Website. Information concerning the processing of personal data acquired by means of cookies can be found in section 8 "Cookie Policy".

The Data referred to in paragraphs (i), (ii), (iii), (iv) and (v) above are hereinafter jointly referred to as 'Personal Data'.

Data acquired for subscribing to and receiving the newsletter and Data acquired via Cookies

To carry out marketing and promotional initiatives for the User, such as the possibility of subscribing to our newsletter and receiving communications and information of a commercial nature, direct marketing on our services and offers, discounts and any other promotional and loyalty initiatives adopted, both through traditional and fully automated contact systems, such as, purely by way of example, through the use of the e-mail address communicated by the User

The User's consent - and the related need to document consent - to processing for these specific purposes (Article 6(1)(a) GDPR)

The provision of data is optional.

Failure to authorize their processing, while not preventing the use of the Website in any way, may not allow you to take full advantage of the benefits we offer to our community through advertising, commercial, and marketing information

 

PERSONAL DATA RETENTION PERIOD

The Data Controller intends to keep Personal Data for no longer than is necessary to fulfil the purposes for which it was collected and processed.

For the purposes referred to in points 1), 2) and 3) of paragraph 3 Personal Data shall be retained for a period not exceeding 10 years from the last purchase or from the cancellation of the account or from the termination of the contractual relationship between the User and the Company; for the purpose referred to in point 4) of paragraph 3, personal data shall be retained for a period not exceeding 24 months from the acquisition of the Personal Data and in accordance with the timeframes indicated in section 8 on Cookies "Cookie Policy".

With regard to Data acquired via cookies, the retention periods are set out in section 8 'Cookie Policy'.

This, except where the Company needs to retain such data to comply with regulatory obligations, or to ascertain, exercise or defend a right of ours in court.

CATEGORIES OF DATA RECIPIENTS

The Personal Data, the subject of the processing, will not be disclosed to third parties. However, they may be communicated to companies connected to the Data Controller, in order to fulfil contracts or related purposes. The data may be communicated to third parties belonging to the following categories:

  • subjects that provide services for the management of the information system used by the Company and telecommunications networks (including e-mail);
  • only in the case of subscription to the newsletter service, entities that provide tools for managing, organizing mailing lists and e-mail marketing, SMS and messaging services (g. mail-up);
  • service companies for the acquisition, recording and processing of data from documents, or media provided and originated by the customers themselves and concerning bulk processing of payments, bills, cheques and other securities;
  • parties performing customer service activities (e.g. call centres, help desks, );
  • firms or companies in the context of assistance and consultancy relationships;
  • persons carrying out control, auditing and certification of the activities carried out by the Company also in the interest of customers;
  • competent authorities to fulfil legal obligations and/or provisions of public bodies, upon request;

The subjects belonging to the above-mentioned categories act as data processors, or operate completely independently as separate data controllers. The list of any data processors is constantly updated and available at the Data Controller's head office.

Any further communication or dissemination shall only take place with the express consent of the User.

TRANSFER OF PERSONAL DATA TO THIRD COUNTRIES

The Data Controller does not transfer Personal Data outside the European Union.

Where this is necessary to achieve the purposes set out in paragraph 3 of this Policy (for example, to use the newsletter service through our provider and its external data processors, if any. With reference to any transfers of personal data to non-EU countries - including those made through the installation of third-party technical cookies where these parties are based in non-EU countries (e.g. Google) - the Data Controller ensures that the processing of Personal Data by these recipients is carried out in compliance with the applicable legislation only with respect to entities located in States with respect to which there is an adequacy decision of the European Commission or by adopting the Standard Contractual Clauses approved by the European Commission or other appropriate measures referred to in Article 46 of the GDPR.

RIGHTS OF THE DATA SUBJECT

The User, as a data subject, is the holder of the rights conferred by the GDPR pursuant to Articles 12-23 of the GDPR. In particular, data subjects have the right to request and obtain, at any time: (i) access to their Personal Data; (ii) information about the processing carried out; (iii) rectification and/or updating of Personal Data; (iv) erasure of Personal Data; (v) restriction of processing; (vi) to exercise the right to object to processing; (vii) portability of Personal Data (i.e. receiving Personal Data in a structured, machine-readable, commonly used format), (viii) to exercise the right to withdraw one's consent to the processing of Personal Data, where such consent is the legal basis for the specific purpose for which the processing is carried out (this, in any case, will not affect the lawfulness of the processing carried out on the basis of the consent given before the revocation), and, finally, (ix) to lodge a complaint with a data protection authority (in Italy: the Garante per la Protezione dei Dati Personali).
